His acts were not only awarded with the Nobel Peace Prize, but your precessors in the European Parliament decided to constitute a prize for the freedom of thought in his honor[2]. This year one man have distinguished in the very way of the Sakharov prize by choosing to share details about the USA:s systematic abuse of their imperial powers to massurvey citizens of the world. The whistleblower Edward Snowden shared information that has put his very freedom to the edge, choosing between a conditional freedom in Putin's Russia or a certain life in prison in the USA. He has, in many ways, become a dissident just like Sakharov were before him. Even though many people walking on this earth have done theirs to ensure our freedom of though is being preserved, Edward Snowden is one of our times most important whistleblower who selfishlessly stood up for fundamental human rights by blowing the whistle on the NSA PRISM. The swedish organization for digital freedoms and rights :DFRI would encourage you to vote for Snowden for the short-list for the Sakharov-prize on this monday[3][4] in order to honor his contribution to aid fundamental human rights and basic democratic principles. The Prize has honoured the efforts of individuals and organisations who defend human rights and freedom of expression annually since 1988. * *Edward Snowden, the former US National Security Agency (NSA) contractor and whistleblower, is among the nominees for the Prize. * While all of this year's nominees are deserving of global recognition for their admirable and courageous action to highlight and defend human rights, it is Snowden's exposure of a massive and unaccountable state sponsored surveillance programme that most closely captures the enduring legacy of the man that the prize is named after. The 1975 Nobel Peace Prize winner Andrei Sakharov. Sakharov was a Russian physicist who rejected the USSR's nuclear programme; he shunned his own work in a secret research laboratory to become an outspoken opponent and critic of the oppressive reach of the Kremlin. Even in exile, Sakharov continued to raise his voice, denouncing social injustice and advocating the benefits of democracy. It is fair to say that Sakharov was a security state insider, working on the powerful weapons that could affect all humanity. Snowden too was a security state insider, working on powerful weapons enabling the interception of the electronic communications. Through his revelations, Snowden voiced objection to the vast scale of secret state surveillance of millions of people around the world, including foreign presidents <http://www.nytimes.com/2013/09/03/world/americas/brazil-angered-over-report…> and companies <http://g1.globo.com/fantastico/noticia/2013/09/petrobras-foi-espionada-pelo…>. The revelations revealed how democratically elected U.S. senators <http://www.latimes.com/world/worldnow/la-fg-wn-clapper-snowden-disclosures-…> had lied. These revelations have released information that is on of strong public concern, including previously classified judgments from the Foreign Intelligence Surveillance Court articulating alarm about governmental conduct <http://www.documentcloud.org/documents/785205-pub-march-2-2009-order-from-f…>. Over thirty years on from Sakharov's exile, Snowden's actions reflect that he is the true inheritor of the Sakharov legacy. Like Sakharov, Snowden decided to defect and stand for the values of society at large against the secretive interests of state machinery. Like Sakharov, Snowden finds himself an outcast, living in asylum and hounded as a result. In divulging classified information, Snowden has greatly jeopardised both his professional and personal livelihood. Beyond displaying great courage, Snowden instigated and much needed and long overdue discussion and debate about the preservation of democratic ideals and the limits of permissible government interference with human rights in a world where national security has been used increasingly to justify the erosion of fundamental freedoms. Snowden's action has showed that blanket mass-surveillance practices are not limited to 'communist states' and 'dictators.' Many members of the European Parliament who grew up within a communist state will surely remember the effect such surveillance -- the purpose of which was nothing more than to control behaviour and dictate the conduct of everyday life. One study of the EU Data Retention Directive poignantly observed that "under pervasive surveillance, individuals are inclined to make choices that conform to mainstream expectations." The Members of the European Parliament must make sure that human rights violations exposed by Snowden are addressed; surveillance must be constrained to cases when justified under international law. They also must make sure that governments remain accountable and transparent in an age where unprecedented technological advances allow for increased ability for subterfuge. By the same token, Members of the European Parliament should also recognise the individual who has exposed these violations; a man who has fought for human rights protection and for the traditions and liberties that the Prize embodies. *Edward Snowden must be the recipient of the 2013 Sakharov Prize.*

Hej listan! Jag är inte jurist och jag har inte läst alla de 439 sidorna men... det här kan inte vara i medborgarnas intresse och nytta menar jag: 27 kap. 16 § Den som i elektronisk form innehar en viss lagrad uppgift som skäligen kan antas ha betydelse för utredningen om ett brott får föreläggas att bevara uppgiften. I föreläggandet ska anges under hur lå ng tid uppgiften ska bevaras. Tiden får inte bestämmas längre än nödvändigt och får inte överstiga 90 dagar. Om det finns särskilda skäl får tiden för be varande förlängas med högst 30 dagar. Föreläggande får inte riktas mot den som skäligen kan misstänkas för brottet eller någon honom eller henne sådan närs tående person som avses i 36 kap. 3 §. "Första stycket innebär att den som i elektronisk form innehar en viss lagrad uppgift som skäligen kan antas ha betydelse för utred- ningen om ett brott får föreläggas att bevara uppgiften. De elek- troniska uppgifter som ett föreläggande kan avse kan vara av vilket slag som helst." s329 16 a § Föreläggande enligt 16 § beslutas av undersökningsledaren eller åklagaren. Om det är möjligt ska föreläggandet ges skriftligt. I annat fall ska den före- lagde så snart som möjligt få ett skriftligt bevis om beslutet. Meddelande om åtgärden får inte obeh örigen föras vidare. Föreläggandet ska innehålla en unde rrättelse om detta. Den som ålagts föreläggandet får be gära rättens prövning av förelägg- andet. För rättens prövning gäller i tillämpliga delar vad som sägs i 6 § s332 Mycket text men: "De elektroniska uppgifter som ett föreläggande kan avse kan vara av vilket slag som helst." Tål att tänkas på tycker jag. Sist undrar jag varför man inte anställer någon med någon som helst teknisk kompetens i ett sådant viktigt ärende? Hej listan! DFRI och Sparvnästet planerar köra ett till CryptoParty, innehåll tror vi att vi enkelt med er hjälp kan fylla på med. Men vi behöver en lokal/datum för att kunna börja hårdplanera. Så hitåt med era tips på lokaler och kontakter! Hjälp gärna till och fråga de ni känner med och meddela. Kanske arbetar ni på ett ställe där man gärna skulle vilja vara samarrangör för ett CryptoParty? I just filed a complaint with the ombudsman against the parliament over this. I argue that the decisions to keep the documents secret were acts of maladministration and a violation of the human right to participate, enshrined in the International Covenant on Economic, Social and Cultural Rights (ICESCR) and the International Covenant on Civil and Political rights (ICCPR). ACTA is dead in Europe, this complaint is about access to documents – essential for civil society work. In 2011 two parliamentary committees asked the parliament’s legal service an opinion on the Anti-Counterfeiting Trade Agreement. The legal affairs committee decided to release the opinions to the public. The parliament’s vice-president responsible for access to documents overturned this decision. The FFII filed an access to documents request but received almost completely blacked out documents. (Blog post with image) EU regulation 1049/2001 on access to documents The EU’s regulation on access to documents has a set of exceptions to openness that have to be balanced with the public interest in disclosure. Examples are the protection of legal advice and the protection of the ongoing decision-making process. The parliament raised both exceptions. In my complaint I provide counter-arguments and an overriding public interest in disclosure. But the regulation on access to documents also has a set of exceptions to openness – with a broad discretion for the institutions – that do not have to be balanced with the public interest in disclosure. An example is the protection of the public interest as regards international relations. If publication of documents may undermine this interest, the institutions do not have to balance this interest with the public interest in disclosure. Just a minimal undermining of the public interest as regards international relations, and secrecy is allowed, however big the public interest in disclosure may be. This is the reason that all requests for the ACTA negotiation documents failed (FFII, In ‘t Veld, EDRi). Also in this case the parliament raised this exception that has such a devastating effect on openness. To counter this, I use two approaches: brute force and human rights. Vienna Convention on the Law of Treaties The parliament argued, based on Article 18 of the Vienna Convention on the Law of Treaties (VCLT), that the EU was under certain obligations concerning due and successful ratification of ACTA and that disclosure of the legal service’s opinions could undermine successful ratification in third countries, and thus harm the protection of the public interest as regards international relations. In the complaint I argue that the parliament’s interpretation of the VCLT is not conform the VCLT text, the history of the VCLT or earlier interpretations of the VCLT. The Parliament erred in law. I conclude that disclosure of the legal service’s opinions is not in conflict with the Vienna Convention on the Law of Treaties or ACTA’s final provisions. There were of course no certain obligations concerning due and successful ratification – the parliament itself rejected ACTA later on. This is the complaint’s core argument. Human rights In addition I argue that EU regulation 1049/2001 on access to documents has to be interpreted in a way that is compatible with the EU’s human rights obligations. I argue that the right to participate is a human right, enshrined in the International Covenant on Economic, Social and Cultural Rights and the International Covenant on Civil and Political rights. Limitations on the human right to participate are possible, but they have to be necessary in a democratic society and proportionate. Regulation 1049/2001 may give the institutions a broad discretion, the ICCPR and ICESCR have a stricter test. Hej listan! Angående det som nämndes på mötet igår i samband med diskussioner om att ta emot pengar som kommer från BBG [1] (via Tor Project Inc.). Organisationen EPIC lämnade tidigare i år in en s.k. EPIC försöker enligt The Daily Dot [2] se om BBG "was being undermined by ... [other forces within the government like] the NSA or FBI." EPIC har nu stämt BBG för att dom misslyckats leverera informationen i tid. Popcorn time. Ett bloggentry [3] från förra sommaren förklarar lite om BBG-pengar för exit-trafik.
